These Terms of Use govern your access to and use of the Hudson Heights RES website, online booking system, account portal, and related services.

Hudson Heights RES is owned and operated by Chris Leary LLC. In these Terms, “Hudson Heights RES,” “we,” “us,” and “our” refer to Chris Leary LLC and Hudson Heights RES. “You” and “your” refer to the person or organization using the website, creating an account, placing an order, or purchasing services.

By using this website, creating an account, submitting an order, or booking an appointment, you agree to these Terms of Use. If you do not agree with these Terms, do not use the website or place an order.

1. Services

Hudson Heights RES provides visual marketing services for real estate professionals and property listings. Services may include:

  • Real estate photography
  • 2D floor plans
  • Virtual staging
  • Additional listing photographs
  • Additional retouching
  • Social media reels
  • Property websites
  • Flyers
  • Other listing and marketing materials

The services available, package contents, prices, and delivery estimates are those displayed on the website, booking system, applicable order page, or written estimate at the time of purchase.

We may change, add, or discontinue services at any time. Changes will not affect an order that has already been accepted unless otherwise agreed with you.

2. Eligibility and authority to place an order

You must be at least 18 years old to use the website or place an order.

If you place an order on behalf of an agent, brokerage, property owner, company, or other organization, you represent that you have authority to do so and to agree to these Terms on that organization’s behalf.

You are responsible for providing accurate information about the property, the client, the requested services, and the person or organization responsible for payment.

3. Accounts and login information

Some services require you to create or use an account through the online booking and delivery system.

You are responsible for:

  • Providing accurate account information
  • Keeping your login credentials secure
  • Not sharing your account with unauthorized users
  • Reviewing orders and property information for accuracy
  • Notifying us if you believe your account has been accessed without permission

You are responsible for activity that occurs through your account unless you notify us promptly of unauthorized access.

We may suspend or close an account if we believe it has been misused, contains inaccurate information, or is being used in violation of these Terms.

4. Booking and order acceptance

Submitting an order or booking request does not guarantee that an appointment has been accepted.

An appointment is confirmed when the booking system or Hudson Heights RES confirms the order and appointment details.

You are responsible for reviewing the following before completing an order:

  • Property address
  • Appointment date and time
  • Services selected
  • Package contents
  • Travel fee, if applicable
  • Contact information
  • Payment information
  • Any special instructions

If you provide an incorrect address or other incorrect information, the appointment may need to be changed or rescheduled. Additional fees may apply if the error affects travel, scheduling, access, or production.

5. Prices, payment, and travel fees

Prices are displayed on the website or booking system and may change from time to time.

The price applicable to an order is the price shown when the order is placed, unless a different price is agreed in writing.

A travel fee may apply depending on the property location.

Hudson Heights RES generally accepts assignments within a 25-mile radius of ZIP code 10040.

There is no travel fee for locations within the borough of Manhattan. Travel fees apply to locations outside Manhattan and vary according to the distance from the service area.

For the most accurate travel fee, enter the complete property address in the online booking system. The applicable travel fee will be displayed before you complete the order.

Payment is due according to the payment terms shown in the booking system, invoice, order confirmation, or written estimate.

You are responsible for any applicable taxes, payment-processing charges, or other charges identified at checkout.

6. Cancellations and rescheduling

For appointments within New York City’s five boroughs, cancellations must be made more than four hours before the scheduled appointment time.

For appointments outside New York City, cancellations must be made more than twelve hours before the scheduled appointment time.

Cancellations made within the applicable cancellation period are subject to a non-refundable fee equal to 50% of the scheduled service total.

All cancellation and rescheduling requests must be made in writing by email or text message.

A request made exactly four hours before an appointment within New York City falls inside the four-hour cancellation period.

Rescheduling requests are subject to the same notice requirements as cancellations. We will make reasonable efforts to accommodate a rescheduling request, but a new appointment time is not guaranteed until it has been confirmed.

7. Weather and unsafe conditions

We may postpone or reschedule an appointment if weather or other conditions make the assignment unsafe or impractical.

This may include:

  • Severe rain
  • High winds
  • Lightning
  • Hurricane conditions
  • Blizzard conditions
  • Tornado warnings
  • Unsafe road or building conditions
  • Other conditions that may endanger people or equipment

When an appointment is postponed because of unsafe conditions, the cancellation fee will generally not apply.

Cloudy or gray skies do not automatically require an appointment to be canceled. Interior photography can usually proceed in those conditions.

For selected final images, a blue-sky adjustment may be available when appropriate. Blue-sky adjustments are not guaranteed and are not intended to materially misrepresent the property’s surroundings or condition.

8. Property preparation

You are responsible for making sure the property is ready to photograph before the scheduled appointment.

A photo-ready property should be:

  • Clean
  • Decluttered
  • Accessible
  • Properly lit
  • Prepared for the requested services
  • Free of unnecessary personal items and objects

You are also responsible for preparing tenants, occupants, sellers, building staff, pets, and other people who may affect the appointment.

If the property is not ready when the photographer arrives, the photographer may make minor adjustments when time allows.

If the property requires substantial preparation, the appointment may be shortened, continued as scheduled, or rescheduled. A rescheduling fee may apply where permitted under these Terms.

9. Access to the property

You are responsible for making sure Hudson Heights RES can access the property at the scheduled appointment time.

This includes:

  • Arranging keys or lockbox access
  • Providing working keys and access codes
  • Confirming building access
  • Coordinating with tenants or occupants
  • Confirming elevator or doorman access when necessary
  • Making sure the photographer can enter all areas requested for photography

If the photographer cannot gain access when the appointment begins, the appointment may be treated as a cancellation. The applicable 50% cancellation fee may apply.

Hudson Heights RES is not responsible for delays caused by tenants, building staff, sellers, agents, property managers, missing keys, incorrect codes, parking restrictions, or other access problems outside our control.

10. Arrival time and delays

You are responsible for arriving on time when your presence is required.

A delay of more than 15 minutes may reduce the available shooting time or require the appointment to be rescheduled.

If the appointment cannot proceed because of a delay or failure to appear, the applicable cancellation fee may apply.

Traffic, parking, building access, and tenant coordination should be considered when planning arrival time.

11. Pets and animals

Pets should be removed from the property during the photo shoot whenever possible.

If a pet cannot be removed, it must be secured in an area that will not be photographed and will not interfere with the photographer or equipment.

You must notify Hudson Heights RES about animals at the property and take reasonable steps to protect the photographer, the animals, the property, and the equipment.

12. Photography and delivery times

Standard photography is typically delivered within 12–18 hours and usually by the next business day.

Delivery times are estimates and may vary because of:

  • Assignment size
  • Number of services selected
  • Property access
  • Weather
  • Weekends and holidays
  • Additional retouching
  • Virtual staging
  • Floor-plan processing
  • Equipment or system problems
  • Events outside our reasonable control

Virtual staging, additional retouching, property websites, and other additional services may require more time than standard photography.

If you have a specific listing deadline, contact us before booking so we can discuss the expected delivery schedule.

13. Floor plans

Current photography packages include a 2D floor plan unless otherwise stated in the applicable package description or order.

Floor plans are marketing materials intended to help buyers and renters understand the general layout and relationship between spaces.

A Hudson Heights RES floor plan is not an architectural drawing, construction document, land survey, appraisal, inspection report, or legal measurement document.

You are responsible for reviewing the floor plan for obvious errors and notifying us promptly of any correction request.

Floor plans should not be relied upon for construction, renovation, permitting, financing, legal, or other technical purposes.

14. Virtual staging

Virtual staging adds furniture or other visual elements to a property photograph to help viewers understand the possible use and scale of a vacant room.

Virtual staging is a marketing representation. It does not represent the room as physically furnished.

Virtual staging should not be used to imply that furniture, fixtures, finishes, appliances, or other items are physically present when they are not.

You are responsible for using virtually staged images in a way that is accurate and appropriate for the listing and applicable advertising requirements.

Virtual staging requests may be subject to additional processing time and revision limits, depending on the package or service selected.

15. Standard image editing

Standard editing is intended to present the property clearly, naturally, and consistently.

Standard editing may include:

  • White-balance correction
  • Exposure, brightness, and contrast adjustments
  • Tonal adjustments
  • Image sharpening
  • Vertical and horizontal correction
  • Lens-distortion correction
  • Dust-spot removal
  • Minor blemish removal
  • Flash-reflection reduction
  • Window-view balancing when appropriate
  • TV-screen replacement
  • Minor fireplace enhancement when appropriate
  • Removal of the photographer’s reflection from mirrors when possible
  • Outdoor sky adjustments when appropriate

The exact editing applied depends on the photograph and the condition of the property.

16. Additional retouching

Additional retouching may be available for an additional fee.

Examples include:

  • Removing furniture or personal property
  • Removing large objects
  • Removing stains or visible damage
  • Repairing walls, cabinets, floors, rugs, or ceilings digitally
  • Furniture replacement
  • Virtual renovation
  • Significant landscaping changes
  • Extensive image reconstruction
  • Other alterations beyond standard image finishing

Additional retouching requests must be submitted in writing by email or text message.

We will provide a price before the additional work begins. Payment may be required before the work is completed.

Additional retouching typically requires 24–48 hours, depending on the request.

Photography and editing are intended to represent the property accurately. We do not knowingly alter images in a way that materially misrepresents the property’s condition, size, layout, or features.

17. Client review and corrections

You are responsible for reviewing delivered materials promptly.

If you believe there is a technical error or an image does not correspond to the requested service, notify us as soon as possible.

Requests involving additional editing, changes to the property, object removal, or other alterations may be subject to additional charges.

18. Copyright and ownership

Unless otherwise agreed in writing, Hudson Heights RES and Chris Leary LLC retain copyright and all other intellectual-property rights in photographs and other original creative materials produced for an assignment.

Payment for services does not automatically transfer copyright or ownership of the photographs.

19. Client license to use photographs

After payment has been received, Hudson Heights RES grants the commissioning client a non-exclusive license to use the delivered photographs for marketing the specific property or listing covered by the order.

Unless otherwise agreed in writing, permitted use may include:

  • The property listing
  • The client’s website
  • Brokerage or team marketing connected to the listing
  • Online listing services
  • Social media
  • Email marketing
  • Printed listing materials
  • Property brochures
  • Public relations related to the listing

The license does not include:

  • Reselling the photographs
  • Licensing the photographs to unrelated third parties
  • Using the photographs for a different property
  • Using the photographs for paid advertising unrelated to the listing
  • Claiming authorship of the photographs
  • Removing copyright or credit information where credit is provided
  • Substantially altering the photographs without permission

Architects, designers, builders, developers, property owners, stagers, vendors, and other project participants do not automatically receive independent usage rights simply because they were involved with the property or assignment.

Additional usage rights may be available by separate written agreement.

20. Client-provided materials and instructions

You represent that you have the right to provide any materials, instructions, logos, property information, photographs, floor plans, text, or other content submitted to Hudson Heights RES.

You grant Hudson Heights RES permission to use those materials as reasonably necessary to perform the requested services.

You are responsible for ensuring that the information and materials you provide do not violate another person’s rights or any applicable law.

21. Portfolio use

Unless you notify us in writing before the assignment, Hudson Heights RES and Chris Leary LLC may display selected photographs and other completed work in portfolios, websites, social media, promotional materials, awards submissions, and related business marketing.

If a property is confidential, embargoed, not yet publicly listed, or subject to another restriction, notify us before the shoot.

We will make reasonable efforts to respect written confidentiality requests received before publication or portfolio use.

22. Website content and intellectual property

The Hudson Heights RES website, including its text, design, graphics, logos, photographs, videos, and other materials, is owned by or licensed to Hudson Heights RES or Chris Leary LLC unless otherwise stated.

You may view and use the website for personal or business purposes related to Hudson Heights RES services.

You may not:

  • Copy or republish website content without permission
  • Reproduce or distribute photographs without authorization
  • Modify or create derivative works from website materials
  • Use the Hudson Heights RES name or logo without permission
  • Use automated systems to scrape or download website content
  • Interfere with the operation or security of the website

23. Third-party services and links

Hudson Heights RES may use third-party platforms for booking, payment, file delivery, floor plans, virtual staging, property websites, or other services.

Those platforms may have their own terms, privacy policies, fees, service limitations, and technical requirements.

Hudson Heights RES is not responsible for the independent operation, availability, security, or policies of third-party platforms.

The website may contain links to third-party websites. Those links are provided for convenience and do not mean that Hudson Heights RES endorses or controls those websites.

24. Website availability

We try to keep the website and booking system available and accurate, but we do not guarantee that they will always be uninterrupted, secure, complete, or error-free.

The website or booking system may occasionally be unavailable because of maintenance, technical issues, third-party platform problems, internet interruptions, or events outside our control.

25. No guarantee of sale, rental, or marketing results

Photography, floor plans, virtual staging, property websites, and other marketing materials can help present a property, but Hudson Heights RES does not guarantee that a property will sell, rent, receive offers, generate leads, or achieve any particular marketing result.

Pricing, market conditions, property condition, location, listing strategy, competition, and many other factors affect real estate results.

26. Limitation of liability

To the maximum extent permitted by law, Hudson Heights RES and Chris Leary LLC will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from or related to the website, booking system, services, delays, lost files, lost profits, lost business opportunities, or inability to use the services.

To the maximum extent permitted by law, the total liability of Hudson Heights RES and Chris Leary LLC for a claim relating to an order or service will not exceed the amount paid for the specific service giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

27. Events outside our control

We are not responsible for delays, cancellations, losses, or failure to perform caused by events beyond our reasonable control.

These events may include:

  • Severe weather
  • Natural disasters
  • Fire
  • Flood
  • Power failure
  • Internet or platform outages
  • Government action
  • Building closure
  • Transportation disruption
  • Illness or injury
  • Labor disputes
  • Public emergencies
  • Other events that could not reasonably be prevented

When possible, we will notify you and work with you to reschedule or complete the affected services.

28. Indemnification

You agree to defend, indemnify, and hold harmless Hudson Heights RES, Chris Leary LLC, and their owners, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from:

  • Your breach of these Terms
  • Your misuse of delivered photographs or other materials
  • Your violation of another person’s rights
  • Inaccurate property or access information
  • Your failure to obtain necessary permissions
  • Your use of the services or materials in violation of applicable law

29. Privacy

Our collection and use of personal information is described in the Hudson Heights RES Privacy Policy.

By using the website or booking system, you acknowledge that information may be processed through third-party booking, payment, account, file-delivery, floor-plan, staging, and website platforms.

30. Changes to these Terms

We may update these Terms of Use from time to time.

The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the website or services after updated Terms are posted means that you accept the revised Terms.

The Terms in effect when an order is placed will generally apply to that order unless a written agreement states otherwise.

31. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.

Any dispute arising from or relating to these Terms or the services will be subject to the applicable courts located in New York, New York, unless applicable law requires otherwise.

32. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

33. Entire agreement

These Terms, together with the applicable order, pricing page, written estimate, service description, cancellation policy, and Privacy Policy, constitute the agreement between you and Hudson Heights RES regarding your use of the website and services.

If there is a conflict between these Terms and a specific written agreement for an assignment, the specific written agreement will control for that assignment.
